  2. Due to the influence of Sense8 Corporation, which thinks that it owns some
  3. of the ideas or source present in Polywog, Polywog is granted to you under
  4. the following license:

  7. END USER LICENSE AGREEMENT
  8.  
  9. This End User License Agreement is part of an Agreement between Ben Discoe
  10. and his licensors ("Ben") and Licensee ("you").
  11.  
  12. Grant of License.  Subject to the terms of this End User License Afreement,
  13. Ben grants you a nontransferable, nonexclusive right (the "License") to use
  14. the Software only in accordance with the applicable user documentation
  15. provided by Ben and only in such a way that Software may not be used by more
  16. than one person or exist on more than one machine at a time.  You may make
  17. one archival copy of Software solely for the purpose of backing-up your
  18. Software and protecting your investment from loss.  You have no right to
  19. receive, use, or examine any source code or design documentation relating to
  20. the Software.

  22. "Software" means, collectively, the vers(s) of Ben's software program(s) in
  23. object code format, together with documentation provided to you by Ben,
  24. including updates, modifications or new releases of such software programs
  25. and documentation that may be provided by Ben to you from time to time.

  27. Restrictions.  You shall not (and shall not allow any third party to)
  28. decompile, disassemble, or otherwise reverse engineer or attempt to
  29. reconstruct or discover any source code or underlying ideas or algorithms of
  30. the Software by any means whatever, or remove any product identification,
  31. copyright or other notices.

  33. Limited Warranty and Disclaimer.  THE SOFTWARE IS PROVIDED "AS IS" WITHOUT
  34. WARRANTY OF ANY KIND INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF FITNESS OR
  35. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  FURTHER, BEN DOES NOT
  36. WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OT THE
  37. RESULTS OF THE USE, OF THE SOFTWARE OR WRITTEN MATERIALS IN TERMS OF
  38. CORRECNESS, ACCURACY, RELIABILITY, OR OTHERWISE.  You should understand that
  39. Ben is not reponsible for and will have no liability for hardware, software,
  40. or other items or any services provided by any persons other than Ben.  Ben
  41. shall have no liability for delays or failures beyond its reasonable control.

  43. Limitation of Remedies and Damages; Force Majeure.  NEITHER BEN NOR BEN'S
  44. LICENSORS SHALL BE RESPONSIBLE OR LIABLE WITH RESPECT TO ANY SUBJECT MATTER
  45. OF THIS SOFTWARE LICENSE AGREEMENT OR ANY ATTACHMENT, PRODUCT ORDER,
  46. SCHEDULE, OR TERMS AND CONDITIONS RELATED THERETO UNDER ANY CONTRACT,
  47. NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY:

  49. (A) FOR LOSS OR INACCURACY OF DATA OR COST OF PROCUREMENT OF SUBSTITUTE
  50. GOODS, SERVICES OR TECHNOLOGY;
  51.  
  52. (B) FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT
  53. LIMITED TO LOSS OF REVENUES AND LOSS OF PROFITS; OR

  55. (C) FOR ANY MATTER BEYOND ITS REASONABLE CONTROL.
